1.Operator and definitions

These Terms of Service (the "Terms") govern the use of the AutoPublishing.house content automation platform (the "Service") operated by:

(the "Operator", "we"). "Client" means the business entity that has contracted for the Service; "User" means a natural person authorized by a Client to use the Service. By using the Service, the Client and its Users agree to these Terms. Where an individual written contract between the Operator and a Client conflicts with these Terms, the individual contract prevails.

2.The Service

The Service is a business-to-business platform that automates editorial workflows: discovery of topics, drafting and editorial review of content, generation of associated media (images, narrated video), scheduling, and publication of the resulting content to the Client's own websites and to third-party platform accounts (YouTube, Instagram, Facebook, X, Reddit, TikTok) that the Client has connected. The Service acts on the Client's instructions; the Client decides which accounts are connected, what content streams are produced, and on what schedule content is published.

3.Accounts and eligibility

  • The Service is intended solely for business use. Users must be at least 18 years old.
  • Users authenticate with personal, non-transferable sign-in links. The Client is responsible for keeping its Users' access up to date and for actions taken through its Users' accounts.
  • The Client may only connect third-party platform accounts that it owns or is expressly authorized to operate.

4.Client content and connected accounts

  • The Client retains ownership of the content produced through the Service for the Client (see Section 9).
  • By connecting a platform account and configuring a publication stream and schedule, the Client expressly instructs and authorizes the Operator to create, upload, schedule, and publish content to that account on the Client's behalf, including setting content metadata and visibility as configured by the Client.
  • The Service will clearly identify the connected account or channel associated with each publication stream. The Client can disconnect an account or suspend a publication stream at any time, which stops further publications to it.
  • The Client is responsible for ensuring it has all rights necessary for the content it instructs the Service to publish (including source materials the Client supplies) and for the content's compliance with the destination platform's rules.

5.Third-party platform terms

Publication features of the Service depend on third-party platforms and their official APIs. Use of these features is additionally governed by the respective platform's terms, which the Client and its Users agree to observe. The Operator does not control third-party platforms; their availability, policies, and technical behavior may change at any time.

5.1 YouTube API Services (Google)

The Service uses YouTube API Services to upload and schedule videos to the Client's connected YouTube channels. By using the YouTube-related features of the Service, you agree to be bound by the YouTube Terms of Service. Google's handling of data in connection with YouTube API Services is described in the Google Privacy Policy; our own handling is described in Section 5.1 of our Privacy Policy, including how to revoke the Service's access via the Google security settings page.

The Service is not directed to children. When uploading to YouTube through the Service, the Client must correctly designate content that is "Made for Kids" within the meaning of YouTube's policies; the Service applies the designation the Client configures for each publication stream, and content uploaded without such configuration is designated as not Made for Kids. If Made-for-Kids content is uploaded, the Client must ensure the designation is accurate, or immediately correct it in YouTube Studio.

5.2 Meta (Instagram, Facebook)

Publication to Instagram professional accounts and Facebook Pages is subject to the Meta Terms of Service, the Instagram Terms of Use, and Meta's Community Standards applicable to the published content.

5.3 X

Publication to X accounts is subject to the X Terms of Service and X Rules and policies.

5.4 Reddit

Preparation and submission of Reddit posts is subject to the Reddit User Agreement, Reddit's content policy, and the rules of each individual subreddit, for whose observance the Client is responsible.

5.5 TikTok

Where the Client connects a TikTok account, publication through TikTok's Content Posting API is subject to the TikTok Terms of Service and TikTok's Community Guidelines. The Client controls each post's metadata, privacy level, and interaction settings as offered for the connected account. By posting music-containing content, the Client agrees to TikTok's Music Usage Confirmation; where a post constitutes commercial or branded content, the Client must use the corresponding disclosure settings and complies with TikTok's Branded Content Policy.

6.AI-generated content

  • Content produced by the Service is generated with the assistance of artificial intelligence (large language models, image and speech synthesis) within an editorial pipeline that includes automated review steps.
  • Automated generation cannot guarantee factual accuracy, completeness, or fitness of any particular output. The Client determines the degree of human review applied before publication and remains editorially responsible for content published to its websites and accounts.
  • The Client is responsible for compliance with any obligations to label or disclose AI-generated or synthetic content that apply to it or to the destination platform.

7.Acceptable use

The Client and its Users must not use the Service to:

  • publish unlawful content, content infringing third-party rights, or content violating a destination platform's rules;
  • publish to accounts they do not own or are not authorized to operate;
  • engage in spam, artificial engagement, deception about the origin of content where disclosure is required, or evasion of a platform's enforcement measures;
  • interfere with the Service's operation or attempt to access other clients' data;
  • share Service credentials or platform authorizations with unauthorized third parties.

8.Scheduling and publication

  • Scheduled publication times are targets. The Service publishes at or as soon as practicable after the scheduled time; exact timing may be affected by platform processing, rate limits, outages, or maintenance.
  • Some platforms perform their own scheduling (for example YouTube's scheduled publication of uploaded videos); in such cases the actual release is performed by the platform.
  • Publications that a platform rejects or removes are governed by that platform's processes; the Service records the failure and surfaces it to the Client.

9.Intellectual property

  • As between the Operator and the Client, content produced by the Service for the Client, and materials the Client supplies, belong to the Client.
  • The Client grants the Operator a non-exclusive license to host, process, adapt, reproduce, and transmit such content solely to the extent needed to provide the Service (including transmission to the destination platforms).
  • The Service, its software, configuration structures, and know-how remain the Operator's property. No rights are granted beyond those expressly stated.

10.Fees

The Service is provided for remuneration agreed in the individual contract between the Operator and the Client. Third-party costs attributable to the Client's use (for example paid platform APIs) are borne as agreed in that contract.

11.Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, the Operator disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement, and does not warrant uninterrupted or error-free operation, nor the continued availability or behavior of any third-party platform or API.

12.Limitation of liability

To the maximum extent permitted by law, the Operator is not liable for indirect or consequential damage, lost profit, or loss of data, nor for damage caused by third-party platforms (including suspension or termination of the Client's platform accounts, removal of content, or changes to platform APIs and policies). The Operator's aggregate liability arising from or related to the Service is limited to the amount the Client paid for the Service in the 12 months preceding the event giving rise to the claim, unless a mandatory provision of law or the individual contract provides otherwise.

13.Suspension and termination

  • The Operator may suspend or restrict the Service, or individual publication streams, in case of a material breach of these Terms, a platform's demand, a security incident, or where continued operation would breach law or platform terms.
  • Either party may terminate as set out in the individual contract.
  • Upon termination, or upon disconnection of an individual platform account, the Operator deletes the stored authorizations (OAuth tokens) for the affected accounts and handles remaining data as described in the Privacy Policy.

14.Governing law and changes

These Terms are governed by the law of the Czech Republic; disputes fall under the jurisdiction of the courts of the Czech Republic. The Operator may update these Terms; the current version is always published at this address with the "Last updated" date above, and material changes will be notified to Clients in advance. These Terms are executed in Czech and English; in case of any discrepancy, the Czech version prevails.
